When I was 15 my mum brought me a horse, I trained him loved him and competed. When I was 16 I got kicked out of home...desperatly missing my gelding. My mum kept the horse and I have been trying to save up enough cash to buy him back, now she is selling him to another home and I still do not have enough money to get him back. I love him more than anything, surely as he was brought FOR me that makes him mine doesn't it? Its like giving someone a birthday present and then taking it back? Does anyone know the laws on possesion in the ACT?

I had a similar problem when my mother found out I was a zoo and she wanted to give my doggy away.

Sad things happened and she did not give my dog.

But horsecherry,

What has happened that your mother wants to sell the horse to someonelse?

because I do not live at home, when they kicked me out they took him away and wouldn't let me see him etc...they said that until I have enough money to buy him back I cannot see him or anything. My mum now wants to sell him because I'm "too late" with saving up

It is a rather sticky situation, I am not an expert in law within Australia, but I am sure that a gift is a gift regardless of circumstances.

I recommend that you seek the advice of a solicitor.

Another sticky subject is whether or not your mum is aware of your special feelings towards animals, if she does and or if she is aware of this webpage and your involvement, you can kiss any chances good bye.

It may be an idea to remove your photo from your profile if you decide to persue this further.

Thanks for the advice TEF I removed my photo from the profile. But it would seem my only option is to come up with the required cash in 4 weeks...an impossibility. Thanks for the help anyway :)

I would suggest that you start by exercising Google and gov websites. You might get lucky. Most likely you will find that a 15 year old cannot own property. So the horse belongs to your parents until they choose to give it to you. If you have told them how you feel and they won't listen, well you titled this post right.
As a last resort, why don't you see if you can find someone who will buy the horse and maybe give a chance to redeem him later. Good luck.

I was "asked" to leave, but i was 21 at the time :(

Secondly property is property no matter of age be that clothes, items, consumables or pets...... If its yours its yours.

No one tried or dared to take Sam away from me though B)

If they knew about you, definately make sure there's no proof before going any further i.e. legal stuffz

I'm 18 now. Was 16 at the time, me and my sister don't get on so basically it was a favouritism thing...if one of us had to leave it was gunna be me. And yes it is legal to kick out a 16 yo because from 16 and above you can claim independance, not that its easy believe me!! They took Calibre away out of spite, now its just a matter of me winning him back :) and i agree with you WKD about the property thing, but I wasn't able to collect ANY of my property from home so no items, clothes etc besides what was on my back at the time. I also had to leave behind my italian greyhound bella, even though she is DEFINENTLY mine no question there, but I cannot have pets where I am staying at the moment, and I would hate to have to separate her from my mothers dog as they have been together since birth. Lifes a b*tch but meh I love it anyway :)
